Hey Fellow Rider, welcome to our terms and conditions! we are so happy you've made it here. This may not be the most exciting document you'll ever read, but it is important to establish what you can expect from us and what we expect from you. and just to be clear, when we say "us", "we" or " TMC", we mean Trip Machine Company .

1.2 these terms and conditions apply when you place an order with us via the website www.tripmachinecompany.com (from now on referred to as the "Online Store").

1.3 by placing your order you agree to be bound by these terms and conditions, or the "Terms" as we will call them from now on. therefore, please make sure you have read and understood them before ordering. 

1.4. only persons who can enter into a legally binding contract under the Indian Contract Act, 1872 can use and/or transact on the Online Store. also, meaning that you must be at least 18 years old or above. If you are under 18 years, you may use and/or transact on the Online Store only with the involvement of a parent or a guardian. you must also have a valid email address and a delivery address in India.

1.1. when you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
1.2. when you browse our store, we also automatically receive your computer’s internet protocol (ip) address in order to provide us with information that helps us learn about your browser and operating system.
1.3. email marketing (if applicable): with your permission, we may send you emails about our store, new products and other updates.

online shopping

these data are processed for the following purposes:

  • we keep your data to support you and handle potential legal claims, maintaining it if we have ongoing obligations or legal requirements to prevent erasure.

how do you get my consent?

2.1. when you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

we may disclose your personal information if we are required by law to do so or if you violate our terms of service.

section 4 - shopify

4.1. our store is hosted on shopify inc. they provide us with the online e-commerce platform that allows us to sell our products and services to you.
4.2. your data is stored through shopify’s data storage, databases and the general shopify  application.

4.3. they store your data on a secure server behind a firewall.

section -5- payment:

5.1. if you choose a direct payment gateway to complete your purchase, then shopify stores your credit card data. it is encrypted through the payment card industry data security standard (pci-dss). your purchase transaction data is stored only as long as is necessary to complete your purchase transaction.
5.2. all direct payment gateways adhere to the standards set by pci-dss as managed by the pci security standards council, which is a joint effort of brands like visa, mastercard, american express and discover.
5.3.pci-dss requirements help ensure the secure handling of credit card information by our store and its service providers.

5.5. we may from time to time offer promotions, discount codes, gifts and other offers. Such offers are valid only for the period specified in connection with such offers and on the terms directly associated with them. 

5.6. offers cannot be combined with other discounts unless expressly stated otherwise in the Online Store. you need to fill in the discount code for the offer before completing the purchase in order to use the offer.

6.1.in general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
however, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
6.2.for these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
6.3. in particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. so if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
6.4. as an example, if you are located in canada and your transaction is processed by a payment gateway located in the united states, then your personal information used in completing that transaction may be subject to disclosure under united states legislation, including the patriot act.
6.5.once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this privacy policy or our website’s terms of service.

7.2. google analytics: our store uses google analytics to help us learn about who visits our site and what pages are being looked at

8.1. to protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
8.2. if you provide us with your credit card information, the information is encrypted using secure socket layer technology (ssl) and stored with a aes-256 encryption. although no method of transmission over the internet or electronic storage is 100% secure, we follow all pci-dss requirements and implement additional generally accepted industry standards.

9.1.what is a cookie?
Whenever you visit our website, we place cookies onto your device for different reasons. A cookie is a small text-based file that is downloaded and stored on your computer, mobile or similar device and contains information about your navigation on the website. They can for example, be used to keep track of which pages you visit on the website, to save the information you entered, or your preferences remembered, such as language settings.

9.2.why do we use them?
We use cookies to give you the full functionality of the website, to customize your user experience, perform analytics and improve our services. Cookies are also used to deliver personalized advertising on our websites, apps, and newsletters across internet and via social media platforms, to get insights regarding for example how many people click on a Social Media ad from us to visit a page on our website. The information is used to measure and optimize advertising in social media. 

9.3.what type of cookies we use?

here is a list of cookies that we use. we’ve listed them here so you that you can choose if you want to opt-out of cookies or not.
_session_id, unique token, sessional, allows shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, persistent for 30 minutes from the last visit, used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite if the shop has a password, this is used to determine if the current visitor has access.
pref, persistent for a very short period, set by google and tracks who visits the store and from where

section 10- changes to this privacy policy

10.1.we reserve the right to modify this privacy policy at any time, so please review it frequently. changes and clarifications will take effect immediately upon their posting on the website. 

10.2.if we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
10.3.if our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

11.2. if you have a complaint regarding any of our products or services, please let us know by contacting Customer Service. in the unlikely event that we are unable to resolve a complaint with you directly, you have the right to refer the dispute to the Grievance Officer.

section 12: product review terms and conditions

12.1.by entering a customer review through the Customer Rate and Review service for any of our products You grant us, a non-exclusive, royalty free worldwide license to use any of your written reviews in relation to its marketing and/or in its advertising, including without limitation, in the online store, in newsletters, catalogs, email and other customer communications and other marketing purposes. 

12.2.further you grant TMC the right to review the reviews before they are published. TMC will only publish comments that contain relevant information about a product, that helps other customers to make informed decisions and to get a clearer understanding of the product. to this end TMC will not publish generally inappropriate comments, indecent or inappropriate language or personally identifiable information.we reserve the right to remove any customer review at any time, for instance if the comment is found to be in breach of the above, product has sold out or if the comment is in other ways outdated.

did you spot or are you a potential victim of what could be a scam, a suspect social media account, website, app or similar - using any of our brand logotypes, images or other intellectual properties? 


here is some guidance to help you recognize if you’re dealing with a scam:


if you’re contacted over email, please verify if the sender has an official TMC email address. If you’re unsure, contact us and we can confirm if the sender is verified or not.

 

is the social media account you suspect verified or not? Verified accounts and pages have a checkmark to show they’re authentic.


have you spotted an activity that you suspect to be a scam? Please report it to us. When reporting a suspected scam, please provide the URL connected to the website, if you are contacted through email please provide the original email as an attachment.


if you’re a suspected victim of a scam, we strongly recommend you to report it to your local police authority.
